CPR Good Samaritan Laws

Some people feared being sued as a result of incorrectly performing CPR first aid in an emergency. In every situation, this fear is unwarranted.

CPR Good Samaritan Laws

All states have passed what are called good CPR Samaritan Laws to help encourage bystanders to assist those in need of help.

These laws help protect anybody who:
  • Voluntarily provides CPR assistance, without expecting or accepting compensation;
  • Is reasonable and sensible;
  • Doesn't provide care beyond the training received; and
  • Is not grossly negligent, or completely careless, in delivering emergency care.
Good Samaritan laws differ from state to state. Become knowledgeable about the laws in your state and other states where you work or travel.

Regardless of location, it's always appropriate to utilize common sense.
  • Activate EMS or an occupational emergency action plan (EAP) immediately.
  • If the scene is unsafe, do not enter!
  • Request a responsible individual for consent before committing care.
  • Never attempt skills that exceed your training.
  • And, as soon as you've started, don't stop until somebody with equal or increased training relieves you.
